1. What Surge Cards is

Surge Cards is a ledger and market-research tool for Pokémon trading card traders. It helps you track your buys and sells, see estimated market prices drawn from publicly available sales data, and monitor cards over time.

2. Estimates, not financial advice

The market prices, averages, trends, and projections shown in Surge Cards are estimates generated from third-party sales data. They may be inaccurate, incomplete, or out of date, and are provided for general information only. They are not financial, investment, or trading advice, and we don't guarantee any price, sale, or outcome. You are solely responsible for your own buying, selling, and pricing decisions.

3. Your account

You sign in with a one-time code sent to your email. You're responsible for keeping access to your email secure and for activity under your account. You must give accurate information and be at least 16 years old to use the Service.

4. Plans, billing & cancellation

Surge Cards offers a free tier and paid subscription plans (currently Trader and Champion). Paid plans are priced and billed in US dollars (USD) in advance on a recurring basis through our payment processor, Stripe, and renew automatically until cancelled. You can cancel anytime from your account — cancelling stops future renewals, and your paid features remain active until the end of the current billing period. Except where required by law (including the Australian Consumer Law), payments are non-refundable. We may change plan features or pricing with reasonable notice.

6. Intellectual property

The Service — including its software, design, and content (but excluding your own data and third-party trademarks) — belongs to Surge Cards. We grant you a limited, personal, non-transferable right to use the Service. You keep ownership of the data you enter.

7. Third-party trademarks & data

Pokémon and related names, logos, and characters are trademarks of their respective owners (including Nintendo, The Pokémon Company, Game Freak, and Creatures Inc.). Surge Cards is an independent tool and is not affiliated with, endorsed by, or sponsored by any of them, nor by PSA, eBay, or any grading company or marketplace. Card names, images, and sprite likenesses are shown solely to help you identify cards, and remain the property of their respective owners. Market data is derived from publicly available third-party sources and is subject to their availability and accuracy.

8. Availability

We work to keep the Service running, but we provide it on an "as is" and "as available" basis. We don't guarantee it will be uninterrupted or error-free, or that its data will always be accurate or available.

9. Limitation of liability

To the maximum extent permitted by law, Surge Cards will not be liable for any indirect, incidental, or consequential loss, or for any loss of profits, sales, data, or trading losses arising from your use of (or inability to use) the Service or your reliance on its data. Where liability can't be excluded, our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes any rights you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

10. Termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or if we stop offering the Service.

11. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here and update the effective date, and we may notify you of significant changes by email. Continuing to use the Service after changes take effect means you accept them.

12. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts. These Terms don't limit any consumer-protection rights you may have under the laws of the country or state where you live.
